Who you are dealing with, and what counts as agreeing
Reading the site is agreeing to these terms. That is how it works everywhere, and it is worth saying plainly.
This website, andiesellshomes.com, belongs to Andie Shepherd, a licensed Indiana REALTOR® (License #RB14044805) doing business as Andie Sells Homes. Real estate services are provided through her brokerage, Mike Thomas Associates, Inc., 9601 Coldwater Road, Suite 107, Fort Wayne, IN 46825.
Throughout these terms, “I,” “me,” and “my” mean Andie Shepherd. “You” means anyone who uses this site.
By using this site, submitting a form, or requesting information, you agree to these terms and to the Privacy Policy. If you do not agree, please do not use the site. You can still call me at (260) 308-2204.
Please read Section 14 carefully. It requires most disputes to be resolved by individual arbitration rather than in court, and it gives up the right to participate in a class action.
This is a marketing site, not a transaction
Nothing here is a listing agreement, a buyer agreement, or an offer on a house.
This site exists so you can learn what I do and get in touch. It is not a place where real estate business is transacted. No page here, and no form on it, constitutes an offer to buy or sell property, a listing agreement, a buyer representation agreement, a commission agreement, or a binding commitment of any kind by you or by me.
Real estate agreements are separate written documents, signed through Mike Thomas Associates. If you have not signed one, you do not have one.
No agency relationship, and no professional advice
Filling out a form does not make me your agent, and this site is not legal, tax, or lending advice.
Sending a message, requesting information, or registering for a class does not create an agency, brokerage, or fiduciary relationship between us. Under Indiana law that relationship begins only with a written agreement. Until then, I am not representing you, and anything you tell me is not covered by the duties an agent owes a client.
Nothing on this site is legal advice, tax advice, financial or investment advice, mortgage lending advice, an appraisal, a home inspection, or a formal opinion of value. Educational material about buying, selling, downsizing, or investing is general information, not guidance about your particular situation. Property details, market statistics, neighborhood descriptions, program amounts, and any home value estimate on this site come from sources believed to be reliable, and are deemed reliable but not guaranteed. They are provided for general information and are subject to change without notice.
Square footage, lot size, room counts, school assignments, tax figures, homeowners association dues, zoning, flood status, and permit history should be independently verified before you rely on them. Down payment assistance programs change their funding, amounts, and eligibility rules frequently, so confirm current terms directly with the administering agency. Any home value figure produced through this site is an estimate generated from available data, not an appraisal and not a guarantee of what a property will sell for.
What you may and may not do here
Read it, use it, share a link. Do not scrape it or run bots against it.
You are welcome to browse this site, print pages for your own use, and share links to it. You may not:
- Copy, scrape, mine, harvest, or bulk download any part of the site or its content, by hand or by automated means
- Use bots, crawlers, or scripts against the site, other than ordinary search engine indexing

Any other company or product names on the site belong to their owners.
What you send me
Send me a question, not your Social Security number. Tell me if you want a review kept private.
When you submit a message, a review, a testimonial, or a photograph, you give me permission to use it in connection with my real estate business, including on this site and in marketing, unless you tell me otherwise. You keep ownership of what you send. Tell me at any time if you want something taken down and I will remove it.
Do not send sensitive personal information through this site. That includes Social Security numbers, bank account or card numbers, and financial statements. Website forms and email are not secure channels for those, and I will never ask for them that way. Your lender, title company, and brokerage have secure systems built for it.
I may remove anything submitted through the site, at my discretion, and I am not obligated to publish anything.
Email and text messages
You control whether I contact you, and you can shut it off in one word.
When you provide your email address or phone number, you are asking me to reply, and I will. If you separately check the box agreeing to text messages, I may text you about what you asked about. Agreeing to texts is never a condition of receiving real estate services.
Message and data rates may apply. Reply STOP to any text to stop receiving them, or HELP for help. Every marketing email has an unsubscribe link. The details are in Section 5 of the Privacy Policy.
Other companies’ sites and services
I link to useful places. I do not run them and cannot answer for them.
This site links to lenders, title companies, inspectors, contractors, down payment assistance programs, government housing resources, property management services, and calculators. Some pages are hosted by outside services, including the forms, which are hosted by GoHighLevel.
I do not control those companies and am not responsible for their content, availability, accuracy, products, services, or privacy practices. A link is a convenience, not an endorsement or a recommendation that you use them. When you deal with another company, their terms govern that relationship, not these.
Fair housing and accessibility
Everyone is welcome here, and if the site itself is in your way, call me and I will get you the information directly.
I support and comply with the federal Fair Housing Act and the Indiana Fair Housing Act. Housing is offered without regard to race, color, religion, sex, disability, familial status, or national origin, and I do not honor discriminatory instructions from any client. If you believe you have experienced housing discrimination, you can file a complaint with the U.S. Department of Housing and Urban Development or the Indiana Civil Rights Commission.
This site is built to be usable with a keyboard, with a screen reader, and at large text sizes, and it is an ongoing effort rather than a finished one. Limits on liability, and indemnification
Two clauses every website has. Here is what they actually mean.
To the fullest extent permitted by Indiana law, neither Andie Shepherd nor Mike Thomas Associates, Inc. shall be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or relating to your use of this site, whether based in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages. Total liability for any claim relating to this site shall not exceed one hundred dollars ($100).
In plain terms: if something on this website is wrong or unavailable and it costs you money, your remedy is limited. This does not limit anything I owe you as your real estate agent under a signed representation agreement, and it does not limit liability that Indiana law does not permit to be limited.
You agree to indemnify and hold harmless Andie Shepherd and Mike Thomas Associates, Inc. from any claim, loss, liability, or expense, including reasonable attorney fees, arising out of your use of this site, your violation of these terms, or your violation of any law or the rights of anyone else.
Disputes: arbitration and no class actions
If we end up in a real disagreement about this website, it goes to a single arbitrator instead of a courtroom, and one person at a time.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury hear your case.
Any dispute, claim, or controversy arising out of or relating to this website, these terms, or the Privacy Policy, including questions about whether this section itself applies, shall be resolved by binding individual arbitration rather than in court. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, seated in Allen County, Indiana, or by telephone or video if you prefer. The arbitrator’s award may be entered as a judgment in any court with jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this section.
You and I each waive the right to a jury trial, and each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class proceeding.
Before starting arbitration, please contact me first. Most misunderstandings get resolved by a phone call, and I would rather have that conversation than a proceeding.
This section applies to disputes about this website. It does not replace or override the dispute resolution provisions of any real estate agreement you sign, which are governed by those documents and by Mike Thomas Associates, Inc., and it does not affect your right to file a complaint with a government agency, including the Indiana Real Estate Commission or a fair housing agency.
If the class action waiver above is found unenforceable as to a particular claim, that claim, and only that claim, shall proceed in court, and the rest of this section remains in force.
Indiana law
Indiana rules, Allen County courts, for anything arbitration does not cover.
These terms are governed by the laws of the State of Indiana, without regard to its conflict of laws rules. For any dispute not subject to arbitration under Section 14, including any action to enforce an arbitration award, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Allen County, Indiana.
If any provision of these terms is found unenforceable, the rest stays in effect. If I do not enforce a provision right away, that is not a waiver of it.
Changes to these terms
If they change, the date at the top changes with them.
These terms may be updated as the site changes or the law does. The effective date at the top of the page always reflects the current version, and continuing to use the site after a change means you accept the updated terms. If a change is significant, I will say so rather than quietly reposting the page.
